TERMS AND CONDITIONS OF TRADE

Our terms and conditions will help you to understand our business conditions and what we are about.

1) Definitions

“Plumber” shall mean Edmunds Plumbing and Gas, or any agents, contractors or employees.

“Customer” shall mean the Customer, or any person acting on behalf of and with authority of the customer

”Services” shall mean any services provided by the Plumber to the Customer.

”Goods” shall mean any Goods provided to the Customer by the Plumber.

”Price” shall mean the cost of the Goods and/or Services as arranged by the plumber for the Customer.

”EPG” Shall mean Edmunds Plumbing and Gas.

2) Acceptance

Any instruction received from the Customer to the Plumber, for the supply of Goods and/or Services shall constitute acceptance of these Terms and Conditions.

If there is more than one Customer, then all Customers shall be jointly liable for Payment of the Price.

Agents or contractors working on behalf of EPG, are not authorised to make any agreements or conditions without written consent of EPG.

3) Price & Payment

The Price shall be either,
i. As indicated on the invoice.
ii. As indicated on the estimate.
The Price is payable to Edmunds Plumbing and Gas within seven days of the invoice date, unless otherwise agreed by Edmunds Plumbing and Gas in writing to the Customer.
GST in not included in the Price.
Payment shall be made by electronic/on-line banking, or cash, unless otherwise agreed by Edmunds Plumbing and Gas in writing.
Any additional costs associated with Payment from the Customer shall be paid to Edmunds Plumbing and Gas.

4) Delivery of goods/Services

Any Goods or Services intended to be delivered to Customers address from the Plumber shall require the Customer
to arrange to receive such deliveries.
The Customer shall be responsible for checking the condition and the quantity of the Goods and Services and that,

 

i. The quantities are correctly represented in the supplied delivery docket and signing the delivery docket to
the fact.
ii. That any defects in the Goods and/or Services are notified on the supplied delivery docket.
iii. That any defects or discrepancies are communicated back to the Plumber in a timely manner and within 24
hours of acceptance of the delivery.
The Plumber is not liable for any loss or damage of the Goods and/or Services when,
i. In the care of the Customer.
ii. Have been checked by EPG and found to be in good order.

5) Risk

All risk shall pass from the Plumber to the Customer after deliver or installation of Goods and/or Services.

6) Title

The Customer agrees that ownership of the Goods and/or Services remains with the Plumber until the Payment has
been received in full.

7) Client’s Disclaimer

The Customer acknowledges that they buy Goods and/or Services relying solely upon their own judgement.
The Customer surrenders any right to sue for compensation or to claim reimbursement arising out of any
misrepresentation made to the Customer by the Plumber.

8) Defects

Goods and Services shall be inspected upon completion of the works with any defects to be brought to the attention
of the Plumber during the inspection.
The Plumber will not be liable for,

i. Any defects of the Goods and/or Service found after this inspection.
ii. Any defects that are covered by any manufacturer’s warranty.
iii. The Plumber will not be liable for any costs associated with any manufacturers defects.

9) Warranty

EPG warrants defects in installation workmanship for three calendar months from the date on the invoice, provided
that the Customer has maintained the Goods and Services in an acceptable manor.
EPG does not warrant any Goods and/or Services provided by the Customer, and the Customer accepts that there
may be addition costs associated with fixing defective goods supplied by the Customer that are payable to the
Plumber.
EPG does not warrant any manufacture warranties and will not be liable for any costs arising from such warranties.

10) Intellectual Property

Any intellectual property developed by the Plumber for the Customer will remain the property of EPG and can be
used for any marketing purposes as seen fit by EPG.

11) Default and Consequences of Default

Failure of Payment of the Price as set out in Part 3 within the nominated time as noted in the invoice shall incur the
following,
i. A late payment fee of $10.
ii. A 2% charge of the outstanding balance of the debt per day compounding until fully paid, starting seven
days after the nominated time as stated on the invoice.

12) Cancelation

The Plumber may,
i. Cancel these terms & conditions at any time by giving a minimum of 24 hours written notice to the
Customers supplied email address.
ii. Cancel delivery of goods & services at any time giving at least 24 hours written notice to the Customers
supplied email address.
iii. The Plumber will not be liable for any financial cost arising from any cancellation.

The Customer agrees to pay any associated cost from the return of goods ordered on behalf of the Customer.
The Customer must give the following notices, before commencement of proposed work.
i. Must give the Plumber written notice of a minimum of three working days in writing to cancel or postpone
any Services that have been booked through a quote or estimate. Failure to do so will incur a charge of 10%
of the quoted or estimated Price.
ii. Must give the Plumber a minimum of four hours verbal notice to cancel or postpone any non-quoted or
estimated Services, failure to do so will incur a charge of $50.

13) Deposits

A deposit of 10% may be required by EPG before any Services are carried out, this will be at the discretion of EPG.
Any deposit given to EPG by the Customer is non-refundable.

14) Privacy Act 1988

The Customer hereby authorises EPG to collect, retain, record, use and disclose consumer and/or commercial
information about the Customer, in accordance with the Privacy Act 1988 and any successive amendments, and for
the execution of fulfilling its business requirements.

15) Variation

This Agreement may not be varied except by a written document signed by or on behalf of EPG and the customer.

16) Buried and hidden services

The Customer will indemnify the Plumber against any claim, loss, liability or proceedings of any kind arising from services which are buried or hidden, being damaged or disturbed. The plumber will not be held liable for any repair work, all repairs will be at the customers expense. .

17) Rock and filled ground

Unless included in written quotes and/or estimates, rock excavation, dewatering or supportive work will be a variation.

18) Blocked drain

The Customer understands that after being informed that the presence of tree and/or plant roots and/or blockages generally indicates damaged to pipes. The Customer understands that blocked drains cannot be fixed just by removing tree and/or plant roots or cleaning the drain. As such, no warranty is provided in relation to future blockages reoccurring.

The Customer understands that Close Circuit Television (CCTV) may or may not be used at the Plumbers sole discretion in an attempt to identify the source of the blocked drain.
Any CCTV equipment that is used will require additional charges subject the the plumbers discretion.
In the event that any equipment becomes lodged or damaged in a customer’s faulty drain, any additional expenses will be added to the services/price.

19) Building and construction industry security of payments Act 1999

If there are any disputes or claims for unpaid Goods and/or Services then the provisions of the Building and Construction Industry Security of Payments Act 2009 may apply.
